Burning Season Regulations

Open Burning Season Starts January 15 and Ends May 1

Permit Required from the Fire Department

You must have authorization to burn yard waste in Agawam. Once obtained, authorization is valid for the entire burning season (January 15th to May 1st) and will allow you burn throughout the season provided conditions are safe. The fee is $10.00 annually. Apply for Step 1 Seasonal Authorization for open burning and pay online by clicking here. You MUST contact the Fire Department on days you wish to burn yard waste. Follow the steps below to ensure safety and compliance with regulations. 

STEP 1: SEASONAL AUTHORIZATION

Once the STEP 1 application is processed, you will be emailed a confirmation number; save this number! It will appear as "FDOB-YY-Nnn". You must contact the Agawam Fire Department on days you wish to burn and this number is required. 

STEP 2: DAILY REPORT OF BURNING

The Daily Report of Burning is required EVERY TIME you would like to burn yard waste. This can be done online by CLICKING HERE, Open Burning STEP 2: DAILY REPORT OF OPEN BURNING or by calling 413-786-2662 after 9:30 on the days you would like to burn. You will be asked for your confirmation number at that time. If dry or windy conditions exist or are likely then you will not be permitted to burn.

IMPORTANT: When completing Step 2: Daily Report of Burning online, you MUST wait for an email stating that your Open Burning STEP 2 application has been approved. If fire conditions are unsafe, you will receive a message that your STEP 2 application has been rejected for the day and you are not authorized to open burn. DO NOT BURN UNTIL YOU HAVE RECEIVED APPROVAL! No applications will be approved prior to 9:30 AM on the the day of burning.  If the Step 2 application is not visible online then fire conditions are unsafe and you are not permitted to burn.

Burning Regulations

Open burning must be a minimum of 75 feet from all buildings, must be conducted between the hours of 10 a.m. and 4 p.m., and must take place on the land closest to the source of material to be burned according to Department of Environmental Protection regulations (310 CMR DEP 7.07).


All open burning activities must comply with NFPA 1 10.11.3, 10.11.4 and 310 CMR 7.07.


PLEASE NOTE: Permits issued in accordance with M.G.L. c. 148 s. 13 and 310 CMR 7.07 are for the burning of residential yard waste. Burning materials on commercial property or as part of a commercial operation or land clearing operation is NOT AUTHORIZED.
